massachusetts divorce inheritance

married 30 years, wife recently got an inheritance from her mother for alot. now she is talking divorce, can the inheritance still be split up in the divorce or is that considered hers only? was in her name only and was transferred to her retirement.

Was it comingled and was there any effort on her part to keep it separate? In the end 99% of all divorces in Mass don't go to trial, so in the end it's all up to you as to what you want / settle on. And if she put it into her retirement account who is the beneficiary of that account? If it's you, she really messed up.

But it shows intent to pass it on to her. I inherited a sum of money about 5-years ago, and my personal attorney warned me about 'intent" and if a divorce goes to trial a good attorney will argue that intent. But, since 99% of all Mass divorces don't go to trial, you can change it any time and argue she isn't entitled to any. But, to keep it simple, just don't. I have about 80% in my name and my kids are the beneficiaries, the other 20% went into joint accounts and/or with her as the beneficiary.

Once divorce is filed, by either party, the automatic restraining order comes into play, and you can't change beneficiaries. So, why do it in the first place?
